  • Agreement: any agreement concluded between Silk & Silver and the customer via the website.

  • Products: all women’s fashion and related items offered through the website.

  • Service: all services and functionalities provided by Silk & Silver via the website.

  • The customer agrees to use the website for lawful purposes only.

  • It is prohibited to use the website for fraud, abuse, spreading harmful software, or violating the rights of others.

  • Silk & Silver reserves the right to limit or terminate access to (parts of) the website in case of misuse or violation of these terms.

Article 4 – Offers

  • All offers on the website are non-binding, unless expressly stated otherwise.

  • Silk & Silver strives for an accurate representation of products.

  • Obvious mistakes, technical errors, or pricing errors are not binding for Silk & Silver.

  • Images, colors, and product descriptions are indicative and may differ from the actual product.

Article 5 – Formation of the Agreement

  • The agreement is concluded once the customer completes the order process and the payment has been successfully processed.

  • After placing an order, the customer will receive a confirmation email.

  • Silk & Silver reserves the right to refuse or cancel orders, for example in cases of obvious errors, stock issues, technical problems, or suspected misuse.

Article 6 – Prices and Payments

  • All prices are listed in United States Dollar (USD) and include VAT, unless stated otherwise.

  • Any shipping costs will be clearly displayed before completing the order.

  • Payment must be made in full via the offered payment methods.

  • Silk & Silver is not liable for delays or errors caused by payment providers.

Article 7 – Delivery

  • Silk & Silver aims to ship orders within the stated delivery time.

  • Delivery times are indicative and not a strict deadline.

  • The risk of loss or damage of products transfers to the customer upon delivery.

Article 8 – Right of Withdrawal

The customer has the right to withdraw from the agreement within 14 days of receipt without giving any reason.

During the reflection period, the customer must handle the product with care.

Products must be returned unused, undamaged, and - if reasonably possible - in their original condition and packaging.

If the customer exercises the right of withdrawal, the product must be returned to the return address provided by Silk & Silver. As our products are shipped directly from our international fulfillment partner, returns may need to be sent to our designated return facility in China.

Return shipping costs are the responsibility of the customer, unless explicitly stated otherwise.

After proper receipt and inspection of the returned items, the purchase amount will be refunded within 14 days.

Article 8a – 30 Day Money Back Guarantee

Silk & Silver offers a 30 day money back guarantee on all products, except for items purchased on sale. This guarantee applies in addition to the statutory right of withdrawal.

If a customer wishes to make use of the 30 day money back guarantee, the product must be returned unused, undamaged, and in its original condition to the return address provided by Silk & Silver. As with standard returns, this may involve shipment to our designated international return facility.

Return shipping costs remain the responsibility of the customer.

Sale items are excluded from the 30 day money back guarantee. For sale products, Silk & Silver may, in consultation with the customer, offer a reasonable compensation or alternative solution at its discretion.

Article 9 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products that, for hygiene reasons, are not suitable for return, provided this is clearly stated in advance.

Article 10 – Warranty and Conformity

  • Silk & Silver guarantees that the products comply with the agreement and reasonable quality standards.

  • Complaints about defects must be reported within a reasonable period after discovery via info@silkandsilverstore.com

  • In case of a valid defect, Silk & Silver will either replace the product or refund the purchase amount.

Article 11 – Liability

  • Silk & Silver is not liable for indirect damage, consequential damage, or loss of profit.

  • Silk & Silver's liability is always limited to the amount of the relevant order.

  • This limitation does not apply in cases of intent or gross negligence.

Article 12 – Force Majeure

  • Silk & Silver is not obliged to fulfill any obligation in case of force majeure.

  • Force majeure includes any circumstance beyond Miller & Rose’s control that prevents fulfillment.

Article 13 – Electronic Communication

By placing an order, the customer agrees that Silk & Silver may send communications via email regarding orders, service messages, and legal notifications.

Article 14 – Intellectual Property

  • All content on the website, including texts, images, and logos, is the property of Silk & Silver or its licensors.

  • Use without prior written consent is prohibited.

Article 15 – Applicable Law and Disputes

  • All agreements are governed exclusively by United States Law law.

  • Disputes are submitted to the competent courts in United States, Delaware.
